ECRAN Climate Policy and Climate Awareness Working Group: Review of Albanian draft climate Law

Albania has submitted the INDCs¸ with assistance provided through ECRAN, and is now on the verge of taking concrete steps on various aspects of low-emission and resilient development strategies, greenhouse gas inventories, climate-proofing, economic modelling, strategic planning, political buy- in, stakeholder consultation, resource mobilisation and legislative processes.

In this framework, Albania requested assistance from ECRAN to review the Albanian draft Law on Climate Change which is now under consideration with the Ministry of Environment. The requested assistance will include a full review of the latest draft Law, and to provide for concrete recommendations and proposals for a final draft which is converging with and in compliance with the EU Climate and Energy policies and legislation and provides the legal framework for further practical development and implementation of climate and energy policies and legislation in Albania.

General Objective

The overall objective is to strengthen regional cooperation between the EU member states, EU candidate countries and potential candidates in the fields of environment and climate change mitigation and to assist them on their way towards the transposition and implementation of the EU environmental and climate policies and instruments which is a key precondition for EU accession.

Specific Objective

The aim of this assignment is to improve the Albanian draft Law on Climate Change which is converging with and in compliance with the EU Climate and Energy policies and legislation and provides the legal framework for further practical development and implementation of climate and energy policies and legislation in Albania.

Expected Results of the workshop

The expected results are:

  • Wider objective and purpose of the legislation clarified;
  • Key elements identified to be included in the proposed climate legislation, so that Albania will meet its international obligations in the framework of the UNFCCC and to ensure the legal background for Albania to take concrete steps towards full convergence with the EU Climate and Energy acquis with climate relevance;
  • Identification of legislative gaps and providing recommendations and guidance for legal gap filling. This will include guidance for identifying elements that should be part of the Draft Climate Law and elements that should be addressed in downstream implementing legislation;
  • Proposal for an improved Albanian Climate Law, discussed with relevant stakeholders and agreed by the Ministry of Environment.
